Tires routinely fail for a variety of reasons, some expected, some not. Many times, the reason for a tire failure may be defective design or defective manufacturing processes. Mr. Lyons has been involved in many tire failure cases resulting from defective tires. While many people believe that every driver should be able to maintain control over a vehicle in a tire failure event, expert race car drivers and design engineers have proven that some types of tire failures on specific vehicles are impossible to control and loss of control frequently results in a tragic rollover or impact.
At the top of Mr. Lyons tire failure cases is the all too frequent tread separation at freeway speeds. Loss of control during a tread separation of a rear tire at freeway speeds is a common event in Arizona and most freeway aprons are littered with tire tread remnants. It is believed by many experts that Arizona’s heat and high freeway speeds precipitates tire failures on a premature basis. Tires that are designed or manufactured in a defective fashion appear to fail more quickly in the Arizona heat at freeway speeds in excess of 75 mph and there exists statistical evidence that certain types of tire-related accidents are more frequently encountered in hot climates than would be expected in cooler areas.
The good news is that Arizona has several tire experts that are very much aware of the Arizona tire failure history and are prepared to assist in proving that an appropriate tire design will prevent premature failure under all anticipated driving experiences and environments.
Mr. Lyons’ tire litigation experience is fairly lengthy and varied. He has been trial counsel in multiple tread separation cases, defective design cases, and a steel sidewall blowout or “zipper" failure case.
